1. Seller information

Hereinafter referred to as "the Restaurant".
Note: The technical platform through which orders are processed is provided by SiteCare.ro (Albu Eduard PFA, Tax ID 54170420). SiteCare acts exclusively as a technical service provider and is not a party to the commercial contract between the Restaurant and the customer. SiteCare.ro does not collect, process, or hold customer payments at any time — any online payments are made directly to the Restaurant's account (see section Payment methods). Full responsibility for ordered products, delivery/collection, and the relationship with the end customer rests entirely with the Restaurant.
2. Subject of the contract
By placing an order on this website, the customer enters into a sales contract with the Restaurant for the selected food products, at the prices and under the conditions displayed at the time of the order.
These Terms and Conditions govern the relationship between the Restaurant and the customer placing an order through the site.
3. Products and prices
- The products available and the prices displayed on the site are periodically updated by the Restaurant.
- Prices are expressed in Romanian lei (RON) and include VAT where applicable.
- The Restaurant reserves the right to modify prices and product availability without prior notice, except for orders already confirmed.
- Product photographs are for illustrative purposes only. The final appearance of the dish may differ slightly from the image shown.
- Allergens: information about allergens for each product is made available to the customer before completing the order (in the product description or in the ordering interface) and is communicated, upon request, at the time of delivery/collection, in accordance with Regulation (EU) No. 1169/2011. The Restaurant is responsible for the accuracy and completeness of this information and can be contacted for further details at the contact details in the Seller information section.
4. Placing and confirming an order
- The customer selects the desired products and completes the order form with the required information (delivery details or the collection option, as applicable).
- The order is transmitted to the Restaurant for processing.
- The Restaurant confirms the order by phone or email as soon as possible after receipt, depending on availability and operating hours.
- If an ordered product is unavailable, the Restaurant will contact the customer to propose an alternative or cancel the relevant product.
- The sales contract is considered concluded when the order is confirmed by the Restaurant.
5. Delivery and collection
5.1 Delivery

Delivery is provided by the Restaurant using its own means, within the zones and hours displayed on the site.

The estimated delivery time is indicated in the shopping cart and may vary depending on distance and order volume.

The delivery cost is displayed in the shopping cart before the order is finalised.

Orders for delivery must exceed a minimum order value indicated in the shopping cart. Orders below this value cannot be completed for delivery.

The customer is responsible for providing a correct and complete delivery address. The Restaurant is not liable for delays or non-deliveries caused by incorrect information provided by the customer.

If the customer cannot be reached or is not present at the delivery address at the time of the courier's arrival, the order may be cancelled and its cost may be retained, depending on the stage of preparation.
5.2 Collection
- The customer may opt to collect the order directly from the Restaurant's premises (the address in the Seller information section) or from the working location displayed on the site.
- After the order is confirmed, the Restaurant will communicate the estimated time by which the order will be ready for collection.
- The order is kept for collection for a reasonable period after the announced ready time. If the products are not collected within this period, they may be discarded for food safety reasons, without any obligation to refund the value of products already prepared and/or paid for.
- Upon collection, the customer checks the order; any discrepancies should be reported on the spot to the Restaurant's staff.
6. Payment methods
6.1 Payment on delivery
The customer may pay for the order in cash or by bank card on delivery, directly to the Restaurant's courier.
6.2 Payment on collection
The customer may pay for the order in cash or by bank card when collecting it from the Restaurant's premises.
6.3 Online card payment
The customer may pay for the order online by bank card via the Stripe payment platform (Stripe Payments Europe, Ltd.). Payment is made directly to the Restaurant's account, set up via Stripe Connect. SiteCare.ro does not intermediate, collect, or hold the amounts paid at any time — the financial flow takes place exclusively between the customer, Stripe, and the Restaurant.
The transaction is processed securely via an encrypted connection. Neither the Restaurant nor SiteCare.ro has access to card data — these are managed exclusively by Stripe in accordance with their security standards (PCI DSS).
If the online payment fails, the order will not be processed. The customer will be notified and may retry the order or opt for another available payment method.
7. Right of withdrawal and order cancellation
Under Government Emergency Ordinance 34/2014 on consumer rights, food products prepared to order are exempt from the 14-day right of withdrawal, as they are perishable goods or goods that deteriorate rapidly.
Order cancellation is possible only before the Restaurant has begun preparing the products, regardless of whether the order is to be delivered or collected. To cancel, the customer must contact the Restaurant by phone as soon as possible after placing the order, at: +40 721 345 678.
If preparation has already begun, cancellation is no longer possible, and the value of the order may be retained.
8. Complaints and returns
- If the products delivered or collected are damaged, incorrect, or do not correspond to the order, the customer must notify the Restaurant immediately upon receipt or as soon as possible, at +40 721 345 678 or comenzi@demorestaurant.ro.
- The Restaurant will review the complaint and propose, as appropriate: product replacement, a discount voucher, or a refund of the value of the affected product.
- The Restaurant is not liable for changes in taste or subjective preferences of the customer regarding products delivered in accordance with the order.
9. Restaurant liability
The Restaurant is liable for:
- The quality and food safety of delivered products, in accordance with current legislation
- The accuracy of allergen information
- Adherence to estimated delivery/collection times, within the limits of objective conditions
The Restaurant is not liable for:
- Delays caused by weather conditions, traffic, or other force majeure events
- Temporary unavailability of the ordering platform due to technical causes beyond its control
- Indirect damages or loss of profit to the customer
10. Force majeure
Neither party is liable for failure to fulfil obligations caused by force majeure events (natural disasters, pandemics, legal restrictions, widespread power outages, etc.). The affected party will notify the other party within 48 hours of the event occurring.
11. Intellectual property
The content of this website (text, photographs, logo, design) belongs to the Restaurant or is used with the necessary rights. Reproduction or use without the written consent of the Restaurant is prohibited.
The technical ordering platform is the property of SiteCare.ro and may not be copied, reproduced, or used outside this website.
12. Personal data protection
Personal data provided when placing an order (name, phone, address, email) are processed by the Restaurant for the purpose of processing and delivering/collecting the order, in accordance with the Privacy Policy available at: Privacy Policy.
13. Dispute resolution
In the event of a dispute, the parties will attempt to resolve it amicably by contacting the Restaurant at the details in the Seller information section.
If the dispute cannot be resolved amicably, the customer may contact:

This contract is governed by current Romanian law.
14. Changes to the terms
The Restaurant reserves the right to update these Terms and Conditions. The updated version will be published on this page with the date of the modification indicated. Orders placed before the modification are governed by the terms in force at the time of placement.
